Cannabis Laws in Crested Butte & Colorado

As you might have heard, if you are an adult over the age of 21 with a valid ID (passport or driver’s license), you can now legally purchase and possess cannabis (marijuana) in Colorado! Keep in mind there are some rules to be aware of before you go to purchase marijuana in Crested Butte or any other Colorado cannabis facility abiding by the new laws.

  • Residents may purchase up to one ounce in a single transaction.
  • Non-residents are restricted to purchasing a maximum of 7 grams of marijuana (¼ ounce) in a single transaction.
  • Both residents and non-residents may possess up to one ounce at any given time.
  • Stores operate from 8am to midnight. Denver stores are required to close by 7pm.

The way the amendment is worded actually allows for possession of one ounce of THC. So in addition to buds (flowers), you can also enjoy many types of cannabis concentrates and edible forms of marijuana during your visit to SOMA Wellness Lounge and other retail locations around Colorado.

Smoking in public may not quite yet be socially acceptable and can lead to trouble with authorities. Discretion is usually required and always appreciated. Amendment 64 does NOT permit the consumption of marijuana “openly and publicly”, you can still get a ticket for doing so, similar to open container laws for drinking in public.

On-site consumption is hard to find with regulations stating that they’re not exempt from indoor clean air regulations, unlike cigar clubs. Cannabis clubs have started to pop-up though they are still in their infancy. Some locations allow indoor smoking since they are ‘private’, others just allow inside vaping and outside smoking.

Avoid smoking near other people such as busy sidewalks and bus stops, and it is unlikely you will attract attention. Personally in Denver any alley works fine for a quick session, but please be aware Denver Police have increased citations for public consumption. In the first three quarters of 2014, Denver Police issued 668 public consumption citations. This amounts to a 470% increase from the same period in 2013, when 117 citations were issued. An e-cigarette personal vaporizer can be your best friend if you want the option to puff without anyone noticing. These have gotten very popular in Colorado, as they don’t really leave any odor and are very low key.” Source

If the police suspect you are driving stoned, they can require you take a blood test. Refusal to do so can result in similar penalties as refusing a breathalyzer test, such as loss of license. The legal limit of THC is 5 nanograms per milliliter of blood. Interestingly the law allows for a defendant to introduce evidence that marijuana did not impair their driving ability. Best advice though is to drive sober in all situations.

Don’t bring any marijuana home Colorado is being watched closely the FEDs, and although it is tempting to bring some of our delicious product back to your home state, doing so has the potential to give the DEA and Feds a reason to crack down. Be smart as the postal inspectors are also keeping a close eye on packages being sent outbound from Colorado.

Your right to possess marijuana in Colorado does not apply when you are visiting national parks, national forests or monuments, or other federal properties such as courthouses. Possession of marijuana on federal land is punishable by up to a year in jail and a fine of $1,000 on the first offense, along with a 15-day mandatory sentence that can be extended to two years in prison for a second offense. After that, perpetrators can receive a 90-day to three-year prison term, and a $5,000 fine.

Yes. It is illegal to drive under the influence of marijuana and it can result in a DUI, just like alcohol.
